This Privacy Policy describes what information and Personal Data (as defined below) we collect about you and the users of the Services (collectively, the “Users”), our legal basis for processing the Personal Data, how Goldwater will use the Personal Data, how the Personal Data will be stored, and your rights in relation to the collection of your Personal Data when you visit, use, or interact with our website, https://goldwaterjewelry.com/, including any subdomains or subpages, (referred to as the “Website” in this Privacy Policy), and all associated services offered on or through the Website, (collectively, the Website, and all other services offered on or through the Website shall be referred to herein as the “Services”).

We know your privacy is important, and we at Goldwater are committed to protecting your privacy while you use the Services.

  1. Who We Are

2. What Information We Collect

Our Website collects information, which includes Personal Data, about you. In this Privacy Policy, and under applicable law, “Personal Data” means any information relating to an identified or identifiable individual; and an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number (e.g., a social security number) or one or more factors specific to his or her physical, physiological, mental, economic, cultural or social identity (e.g., name and first name, date of birth, biometrics data, fingerprints, etc.).

In this Section, we will explain what type of information and Personal Data we collect, and how it is collected. We collect information and Personal Data about you in a few different ways when you use the Services or visit the Website. Should you decide to not provide Goldwater the Personal Data identified in this Privacy Policy, then we may not be able to provide the Services to you.

 

  1. Creating an Account

To access certain portions of the Website, you may be required to create an account (an “Account”).  When you create an Account on the Website, we require and request certain information and Personal Data from you, which may include your email address, full name, business name, phone number, other contact information, and/or location (including state and country, as applicable). By provide this information to Goldwater, you consent to Goldwater’s storage, use, and processing of that information.

 

  1. Communications Information

When/if you contact Goldwater with requests for assistance, questions, or otherwise, then we will collect the information you provide to us during those interactions. These records and communications may be monitored or recorded to ensure high quality service and for training purposes. In addition, if you post or publish any information on the Website, we will collect, store, and process that information and those communications as part of our Services.  In addition, we may use any such information to investigate any possible violations of the Goldwater Terms and Conditions of Use and Sale or this Privacy Policy.

 

  1. Payment Information

Certain Services, and certain software and products made available through the Website require payment.  To make any such payment through the Website, payment information will be required. Goldwater does not store or directly access any of your payment information or account information. Instead, Goldwater utilizes third party payments processors to process all payments.  Goldwater does not have direct responsibility or control over your payment information or account information. Goldwater’s agreements with the third parties service provides that receive your payment information and/or account information require them to keep the information secure and confidential.

As such, Goldwater cannot and does not guarantee that the transmission of your payment information or account information will always be secured against access from unauthorized third parties. There is always the chance that unauthorized third parties will be able to defeat the security measures taken by Goldwater or the third parties we have contracted with.  Goldwater makes no representations or warranties and assumes no liability or responsibility for improper access to or disclosure of your payment information or account information due to unauthorized third-party access, errors in transmission, or other causes beyond Goldwater’s control. To help in this process, you should never share your username, password, or other information pertaining to your Goldwater Account with anyone.

  1. Automatically Collected Information

When you visit the Website and/or utilize the Services, Goldwater automatically collects some information about you and your activities. For example, when you visit the Website, Goldwater automatically collects information about your Internet Protocol (“IP”) address, your computer operating system and browser type, the amount of time you spent accessing the Website, language preferences, and the website you were viewing directly before you visited the Website.

The Website also collects certain information about your usage and activity on the Website by using certain technologies, such as:

  • Goldwater automatically collects information by using “Cookies.” Cookies are small data files that have unique identifiers and reside, among other places, on your computer, mobile device, and on the Website. Cookies help Goldwater improve the Website and your experience when visiting the Website, by helping with tasks such as recognizing you and your browser when you visit the Website, analyzing User behavior, and remembering your settings from previous visits.
  • Mobile Device Information. When you access the Services by using a mobile device (e.g., a cell phone or tablet), Goldwater may collect, store, and process certain identification numbers associated with the device (e.g., an IDFA, unique device ID, or Google Ad ID), and information about the mobile device model, type, manufacturer, operating system, and phone number.
  • Web Beacons. Goldwater collects information by using web beacons. Web beacons are small, electronic images that may be used on a website or in emails. Goldwater utilizes web beacons to count visits, deliver cookies, and understand Website usage.
  • Do-Not-Track Signals. We currently do accept Do-Not-Track Signals and do not employ technology that recognizes Do-Not-Track Signals from your browser.
  • Log data. When you use the Website, Goldwater collects information called “log data” or “log information.” This information includes the browser type and operating system that were used to visit the Website, the associated IP address for the visit, the time of day of the Website access, and any language preferences. Goldwater may log this information for internal recordkeeping and business purposes. For example, the log information is important for audit, security, quality improvement, and other internal business purposes.
  • Information About How You Use the Services. We may collect information about your participation and actions on the Services. This may include information such as the pages on the Website you visit, how you browse the Services, and the various functions that you use.
  • Location Data. Goldwater does not currently track or collect your precise geographic location or any latitude or longitude coordinates associated with your location. However, it’s important to note that some types of collected information (e.g., your IP address) may possibly be used to provide an approximate location of your computer or mobile device. Goldwater does not currently take any steps with this type of information to identify your precise geographic location.

As explained above, we collect several types of information and Personal Data. In this section, we explain how we use the information that is collected.

 

  1. Main Uses of Collected Information

The main reason we collect information (including Personal Data) is to provide and improve the Services. With that in mind Goldwater will use your information and Personal Data:

  • Where you have given Goldwater consent to use your information and Personal Data (which includes any Sensitive Personal Data) to provide the Services.
  • To employ you or consider you for employment.
  • To provide information to you about our Services and/or new products if you have given consent to receive those types of messages.
  • Administer the Website and Services to diagnose and resolve technical problems.
  • Send you notifications and communications to the email address that you have provided in relation to the Services.
  • Generate, create, and review reports and other data about the Users on the Website and to conduct research on the Website and any usage or patterns.

  • Provide you and other Users with customer support.
  • Carry out or fulfill our legal obligations, regulatory requirements, and/or enforce Goldwater’s rights arising from any contractual agreement (such as our Terms and Conditions of Use and Sale) between Goldwater and you.

  1. Other Analytic Tools

Goldwater may also use analytic tools and services to understand how effectively Goldwater’s content and Website are performing, what interests you and other Website Users, and to help improve how the Website and Services are performing. This may include using web beacons and Cookies to count the number of visitors to the Website and to track the number of Users accessing the Services.  Goldwater will not use information that is collected or created from these analytical tools to attempt to personally identify you or any other User on the Website; the information will be used for statistical purposes only. However, if you have created an Account and logged into the Website, Goldwater may combine any of the collected information (including Personal Data) with any other information in our possession, (including Cookies) to analyze how Users, including you, are using the Services.

 

  1. Anonymous or De-Identified Data

Goldwater may anonymize and de-identify collected information, including Personal Data.  As a result, Goldwater may use, process, or disclose any such aggregated and/or de-identified information in accordance with applicable law, which does not generally restrict or prohibit the use of aggregated and/or de-identified information. Accordingly, no such use is prohibited by this Privacy Policy, and all such anonymized and de-identified information may be used and disclosed to third parties without limitation.

 

  1. Legal Basis for Processing Personal Data

Goldwater may collect, store, and/or process your Personal Data because:

  • We have a legally binding contract with you;
  • You have given consented or given Goldwater permission to do so;
  • We are providing the Services to you; and/or
  • To comply with applicable law.

For of these reasons, Goldwater may legally collect, store, and/or process the Personal Data we have about you.

 

  1. Marketing

Goldwater may contact you for direct marketing purposes. However, will always provide you with a choice to opt-in or opt-out in accordance with applicable law.  On the other hand, no third party acting on Goldwater’s behalf will contact you for any direct marketing purposes. Should this policy change in the future, then Goldwater will provide you with a choice to opt-in or opt-out prior to sharing your personal information with any third parties or their affiliates for their direct marketing purposes. To be clear, Goldwater will not automatically add you to a marketing or mailing list without specifically asking you to first opt-in or opt-out of the communications.

 

  1. Disclosure of Your Information to Third Parties

Goldwater does not sell, rent, or trade your Personal Data to third parties. We share your information only in the ways we describe below. We may share your Personal Data with third parties to perform services on our behalf such as:

  • Fulfilling orders and delivering packages
  • Scheduling and performing installations and providing Services
  • Servicing products
  • Sending marketing communications
  • Fulfilling subscription Services
  • Conducting research and analysis
  • processing payments

We may share Personal Data in connection with software, products, and services provided by third party vendors.  This Personal Data may be shared in accordance with licenses or other contractual agreements between Goldwater and such third party vendors.

In addition, there are a number of reasons why Goldwater may share your information and Personal Data with authorized third parties. For example, we will share your information and Personal Data for the following reasons:

  • Technology Services Providers. Goldwater may disclose Personal Data, as required, to applicable authorized service provides, including cybersecurity partners, infrastructure partners, fraud analytics companies, analytics service providers, customer support service providers, payment providers, and similar partners.
  • Applicable Law. In our discretion, Goldwater may disclose Personal Data to, (i) enforce Goldwater’s Terms and Conditions of Use and Sale, including the investigation of any potential violation, (ii) satisfy applicable law, legal process, regulation, subpoena and/or court order, or other government request, (iii) investigate any claim or allegations and defend itself against any third party claims or allegations, (iv) protect against harm to the rights, property or safety of Goldwater, Goldwater’s Users, or any member of the public, as required or permitted by applicable law and (v) detect, prevent or otherwise address criminal or potentially criminal behavior, or security or technical issues.
  • In connection with any company transaction, such as a merger, sale of all or a substantial portion of Goldwater’s assets or shares (including a change of control or acquisition of all or a portion of our business), reorganization, or in the event of bankruptcy, dissolution, divestiture or any related or similar proceedings.

 

In all cases, Goldwater requires third parties to respect the security and privacy of our User’s Personal Data. As such, Goldwater has taken appropriate steps and required third parties to have appropriate security and contractual measures (like encryption and data processing agreements) in place to help ensure that your Personal Data is always handled in accordance with applicable law and this Privacy Policy. However, Goldwater cannot be and is not responsible for how any third party handles or processes your Personal Data.

 

  1. International Transfers

The information and Personal Data Goldwater collects may, in certain cases, be transferred, stored, and/or processed in countries outside of the country or jurisdiction of where you were when you utilized the Services or accessed the Website.  If you are located in the European Economic Area (“EEA”), your Personal Data may be transferred, stored, and/or processed outside of the EEA to other countries, which may include the United States of America. All international transfer of Personal Data will be made in accordance with applicable law.

 

  1. Data Security

We have taken precautions and put security measures in place to protect and help prevent the loss, misuse, improper access, and/or alteration of the information and Personal Data stored by Goldwater. These measures include the use of Secure Socket Layer (SSL) encryption technology as well as other internal security measures that are applied to the storage and transfer of User information. However, it is important to note that despite the precautions taken by Goldwater, the Internet is not a secure environment, and no information transmitted over the Internet can be guaranteed completely secure. As such, Goldwater cannot and will not ensure or warrant the security of any information (including payment information and account information) transmitted by you or any User via the Services over the Internet, and Goldwater will not accept any liability for any unintentional or unauthorized results or disclosures.

 

  1. Data Retention and Account Termination

Goldwater will only store your information and Personal Data until you delete your Account or contact Goldwater to inform us that you would like your information and/or Personal Data removed from the Website.

You may close your Account and/or remove any information by visiting your profile on the Website. If you remove any of your information or Personal Data from the Website, the information or Personal Data will be immediately deleted from our Servers. On the other hand, if you contact Goldwater to have any information or Personal Data removed, then Goldwater shall delete the requested information or Personal Data within ten (10) business days of any the receipt of your request.

We will only retain your information or Personal Data for longer than that provided above in order to satisfying any legal, accounting, or reporting requirements.

The right to erasure If you would like Goldwater to erase all of your Personal Data in its possession and Goldwater does not have a legal reason to continue to process and store it, we will erase your Personal Data in accordance with your request and this Privacy Policy.

In that case, Goldwater will keep just enough data to make sure we respect your request in the future. In addition to the rights available EEA residents above, anyone utilizing our Services may have options available under applicable law. If you would like to request to review, correct, or delete Personal Data that you have previously provided to Goldwater, or if you would like to request to receive an electronic copy of your Personal Data in order to transmit the Personal Data to another company (to the extent the right to data portability is provided to you by applicable law), you may contact us at [email protected].  In your request, please specifically state what Personal Data you would like to access. We may require that you verify your identity, in accordance with applicable law, before responding to any such requests. We will respond to and process all requests consistent with applicable law.

If you are a resident of California, under 18 years of age, and are a User of the Services, you may ask us to remove content, information, and/or Personal Data that you have provided to Goldwater by writing to [email protected].

Please note that your request will not ensure complete or comprehensive removal of the information or Personal Data, as, for example, another Approved User may have accessed or copied your Personal Data.

The Service may, from time to time, contain links to and from websites owned or operated by third party companies or service providers. If you follow a link to any of these third party websites, please note that these services have their own privacy policies and that Goldwater does not accept any responsibility or liability for those companies or their privacy practices.   1. Our Policy Towards Children

The Service and Website are not directed towards any individual or person who is under 18 years of age. Goldwater does not knowingly or intentionally collect Personal Data from persons under 18. If you are a parent or guardian, and you learn that your child or minor under the age of 18 have provided Goldwater with Personal Data, please contact Goldwater immediately. If we become aware that we have collected Personal Data from a minor without verification of parental consent, then we will immediately remove that information from our servers.

Pursuant to California Civil Code Section 1798.83, residents of the State of California have the right to request certain information from companies operating in the State of California, including information regarding such Company’s disclosure within the preceding calendar year of that California resident’s personal information to third parties for direct marketing purposes. Additionally, the law provides that a company may comply with the law by disclosing in its Privacy Policy that it provides consumers a choice, to opt-out or opt-in, before sharing personal information with third parties for direct marketing purposes.

Currently, Goldwater does not share personal information with third parties or their affiliates for direct marketing purposes. Should this policy change in the future, then Goldwater will provide you with a choice to opt-in or opt-out prior to sharing your personal information with any third parties or their affiliates for their direct marketing purposes.

Goldwater reserves the right to modify or amend this Privacy Policy, at any time and in any manner. We will also change the date this Privacy Policy was last modified at the top of this Privacy Policy, and post a notification on the Website notifying you to changes in the Privacy Policy.
